This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a legal entity) and Randomware Audio ("Developer", "Company", "we", "our", or "us") governing your use of the EP Toolkit software application, including any updates, patches, documentation, and related materials (collectively, the "Software").

By installing, copying, accessing, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.


1. License Grant

Subject to the terms of this Agreement and applicable payment requirements, Randomware Audio grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software for lawful personal or commercial use.

This license grants usage rights only and does not transfer ownership of the Software or any intellectual property rights.


2. Ownership and Intellectual Property

The Software is licensed, not sold. All rights, title, and interest in and to the Software, including its code, design, branding, user interface, documentation, and related materials, remain the exclusive property of Randomware Audio and its licensors.

All trademarks, product names, and company names referenced in the Software remain the property of their respective owners.


3. Restrictions

You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except where explicitly permitted by applicable law;
  • Modify, adapt, or create derivative works based on the Software;
  • Redistribute, resell, rent, lease, sublicense, or commercially exploit the Software except as explicitly authorized;
  • Remove or alter copyright notices, branding, or license information;
  • Use the Software in violation of applicable laws or regulations.

4. Third-Party Devices and Services

The Software may interact with third-party devices, hardware, firmware, services, or communication protocols that are outside the control of Randomware Audio.

Third-party manufacturers or service providers may modify firmware, software behavior, communication protocols, project formats, supported functionality, or platform behavior at any time and without notice. Such changes may result in partial or complete incompatibility with the Software.

Randomware Audio intends to maintain compatibility and provide updates when reasonably feasible. However, continued compatibility, uninterrupted operation, or restoration of functionality cannot be guaranteed.

Randomware Audio is not responsible for modifications, restrictions, service interruptions, protocol changes, discontinued support, or compatibility issues introduced by third parties.


5. No Affiliation

EP Toolkit is an independent software product developed by Randomware Audio.

Unless explicitly stated otherwise, Randomware Audio is not affiliated with, endorsed by, authorized by, or associated with any third-party manufacturer, brand, or service referenced by the Software.


6. Updates and Changes

Randomware Audio may release updates, patches, fixes, or improvements for the Software at its discretion.

The Company is under no obligation to provide any specific update, feature, compatibility fix, or continued support for any particular hardware, platform, operating system, firmware version, digital audio workstation (DAW), or third-party service.

Features and functionality may change over time.


7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RANDOMWARE AUDIO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • CONTINUED COMPATIBILITY;
  • UNINTERRUPTED OR ERROR-FREE OPERATION.

The Company does not guarantee that the Software will meet your requirements or operate without interruption, errors, or compatibility issues.


8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RANDOMWARE AUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits;
  • Loss of business;
  • Loss of data;
  • Hardware issues;
  • Device malfunction;
  • Service interruptions;
  • Incompatibility caused by third-party changes.

IN NO EVENT SHALL THE TOTAL LIABILITY OF RANDOMWARE AUDIO EXCEED THE AMOUNT ACTUALLY PAID FOR THE SOFTWARE.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.


9. Project Conversion and Export Limitations

The Software attempts to translate and export projects between different hardware and software environments as accurately as reasonably possible. However, not all device features, workflows, instruments, effects, routing options, or behaviors can be reproduced identically across all supported digital audio workstations (DAWs).

Certain features may be unavailable, simplified, approximated, rendered differently, or omitted entirely due to technical limitations, unsupported functionality, platform differences, firmware changes, or DAW-specific constraints.

Exported projects may sound different from the original device playback or intended hardware behavior.

Randomware Audio does not guarantee identical reproduction, feature parity, or sonic equivalence across devices, DAWs, plugins, operating systems, or audio environments.


10. Payments and Refunds

Payments, billing, taxes, licensing, and transaction processing may be handled by third-party payment providers or resellers.

Refund requests are subject to the applicable platform policies and any refund terms provided by Randomware Audio.

Unauthorized chargebacks, fraudulent payment disputes, or abuse of licensing systems may result in suspension or termination of license access.


11. User Responsibility

You are solely responsible for:

  • Verifying compatibility before use;
  • Maintaining backups of important data and configurations;
  • Using the Software in accordance with applicable laws and manufacturer guidelines;
  • Any risks associated with modifying, configuring, or communicating with third-party devices.

12. Termination

This Agreement remains effective until terminated.

Your rights under this Agreement terminate automatically if you violate any provision of this Agreement.

Upon termination, you must stop using the Software and delete all copies in your possession.


13. Privacy

If the Software collects or processes any user data, such collection and use shall be governed by the applicable Privacy Policy provided by Randomware Audio.


14. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Serbia, without regard to conflict of law principles.

Any disputes arising from or relating to this Agreement shall be subject to the jurisdiction of the competent courts of the Republic of Serbia.


15. Severability

If any provision of this Agreement is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.


16. Entire Agreement

This Agreement constitutes the complete agreement between you and Randomware Audio regarding the Software and supersedes any prior agreements or understandings relating to its subject matter.
